Oporto Franchising Pty Limited – Oporto Come To Me Promotion How to Enter To be eligible to enter, you must be able to host the event in New South Wales. You must post a photo on Instagram or Facebook showing us why you should win Oporto on Wheels to cater at your event. There will be one winner during the promotion period. Entries will be based on the humour, originality and creativity of the entrant’s submissions as determined by the judges in their absolute discretion. Terms & Conditions (1) The promotion is conducted by Oporto Franchising Pty Limited (ABN 86 083 011 349) (Oporto) of Level 12, 12 Help Street, Chatswood, New South Wales, 2067 Australia (Promoter). (2) Entry into the promotions constitutes acknowledgement and acceptance of these terms and conditions. Information on how to enter, all entry instructions, advertising material and prize information published by the promoter form part of these terms and conditions. (3) An Entrant is any person who has entered this promotion in accordance with these terms and conditions. Entry is open only to New South Wales residents. Employees or directors of the Promoter, immediate family members of any employee or director of the Promotor, any retailer, supplier, associated company or agency of the Promotor and any person who the Promoter has previously notified are not eligible to enter. (4) If the Prize Winner is under the age of 18 years, the prize will be awarded to the Prize Winner’s parent or legal guardian on behalf of the Prize Winner. It is the responsibility of the Prize Winner’s parent/legal guardian to prove their parental status / legal guardianship at the time of Prize Winner notification. (5) Entries not completed in accordance with these terms and conditions are void. Entries will be deemed void if stolen, forged, mutilated or tampered with in any way. (6) Multiple entries are permitted. Entrants can only enter in their own name. The use of automatic entry software, mechanical or electronic devices that allows an individual to automatically enter the Promotion is prohibited and may render all entries submitted by that individual invalid. (7) Entries for the promotion open 10:00am AEST Friday 3rd February and close 23.59pm AEST on Wednesday 29 March 2017 (the ‘Promotional Period’). (8) To be eligible an entrant must take a photograph that explains why they deserve to win this competition and post it on Instagram or Facebook with the hashtag “#oportocometome”. (9) Judging for the prize will take place at Level 12, 12 Help Street, Chatswood, NSW, 2067 at 17:00pm AEST on Thursday 30 March 2017 and the Judges will select the Prize Winner (together with a second and third place). Note there are no prizes awarded for second and third place. (10) This is a game of skill and chance plays no part in determining the Prize Winner. All valid entries will be judged. (11) Judging will be conducted by a panel of independent judges appointed to run the Promotion (Judges). (12) Entries will be judged based on the humour, originality and creativity of the entrant’s submission as determined by the judges in their absolute discretion. The judges’ decision is final and no correspondence will be entered into. (13) There is one prize to be awarded. The Prize comprises of: A visit by Oporto on Wheels to a private residence in New South Wales on a date (being no later than 30th June) with the residence and date nominated by the Prize Winner where the Promoter will provide food (Food items to be chosen by the Promoter) for up to 50 guests. The winner must have permission for Oporto to be on the nominated property. Oporto reserves the right to change the menu items subject to product availability. (14) The total prize pool is estimated at $2,500 and this is a game of skill and chance plays no part in determining the Prize Winner. All valid entries will be judged. Judging will be conducted by a panel of independent judges appointed to run the Promotion (Judges). (15) Prizes are not transferable, exchangeable or redeemable for cash. Prize values are in Australian dollars and are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in the value of the prize. To the extent permitted by law, the Promoter makes no representations or warranties as to the quality, suitability, or merchantability of the prize(s). (16) The Prize Winner will be notified in writing via social media by 17:00pm AEST on 31 March 2017. (17) The prize comprises the elements outlined in clause 13. Any and all ancillary costs associated with the prize are solely the responsibility of the winner. (18) In the event that the initial Prize Winner is unable to have the event at their chosen location, on the date nominated, then the Prize Winner will forfeit the prize, and the second best entrant will be contacted and offered the prize. If the second best entrant is unable to have the event at their chosen location on the date nominated then they will forfeit the prize and the third best entrant will be contacted and offered the prize. In the event that the third best entrant is unable to have the event at their chosen location on the date nominated then no prize shall be awarded. (19) In the event that: (a) the Promotor is unable to contact the initial Prize Winner by 17:00pm AEST 7 April 2017; or (b) the initial Prize Winner fails to nominate the location of the private residence or the date of the event by 17:00pm 7 April 2017 referred to in clause 13, then the initial Prize Winner will forfeit the prize and the prize will be awarded to the second best entrant. (20) In the event that: (a) the Promotor is unable to contact the second best entrant by 17:00pm AEST 14th April 2017; or (b) the second best entrant fails to nominate the location of the private residence or the date of the event by 17:00pm 14th April 2017 referred to in clause 13, then the second best entrant will forfeit the prize and the prize will be awarded to the third best entrant. (21) In the event that: (a) the Promotor is unable to contact the third best entrant by 17:00pm AEST 21st April 2017; or (b) the third best entrant fails to nominate the location of the private residence or the date of the event by 17:00pm 21st April 2017 referred to in clause 13, then no prize shall be awarded. (22) The Judges will award the prize in their absolute discretion, and the Judges reserves its right not to award the prize if a suitable winner cannot be found. (23) If a prize is unavailable for any reason, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. (24) Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete, inaudible or incomprehensible entries will be deemed invalid. (25) By entering this Promotion, the Entrant consents to the Promoter’s use of his or her personal details (including name, likeliness, image and/or voice) for any marketing and advertising (in any form of media) that the Promoter may choose for an unlimited period without remuneration. (26) The Promoter reserves the right, at any time, to verify the validity of entries. The Promoter reserves the right to verify the Entrant’s identity particulars (including but not limited to an Entrant's identity, age and place of residence). Proof of identification, age, residency and entry considered suitable for verification is at the discretion of the Promoter. (27) The Promoter reserves the right to prohibit the winner(s) taking part in any or all aspects of the prize(s), if the Promoter determines, in its absolute discretion that the winner(s) are not in the mental or physical condition necessary to be able to safely participate in the prize(s). (28) It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. (29) The Promoter reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct that may jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from any offender(s) are reserved. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. (30) If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, and subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion as appropriate. (31) To the full extent permitted by law, the Promoter, the Promoter’s officers, employees and agents, the Promoter’s related companies and all those entities' personnel exclude all liability for any loss (including any damage, claim, injury, cost or expense, including loss of opportunity) which is suffered or incurred by any individual in connection with the Promotion or prizes, including but not limited to: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these terms and conditions; (e) any tax liability incurred by the winner or entrant; (f) any prize(s); or participation in or use of any prize(s). (g) any direct, indirect, economic or consequential loss; (h) any loss arising from the negligence; and (i) any liability for personal injury or death. Nothing in these conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under any Act or similar consumer protection laws in the States and Territories of Australia. (32) The Promoter's decision in relation to any aspect of the competition is final and binding on every entrant. No correspondence will be entered into. (33) The Promoter may require the winner(s) from the promotion to partake in media exposure, including but not limited to future promotional, marketing and publicity without any further reference, payment or other compensation. (34) All entries and entry details become the property of the Promoter. The Promoter may use the Prize Winner(s) personal details (including name, likeliness, image and/or voice) for any marketing and advertising (in any form of media) compensation, unless the Prize Winner(s) advises the Promoter otherwise when accepting the prize.
